1. Acceptance
These Terms are an agreement between you and Kiwi Home Agent LLC, a California limited liability company (“Kiwi”). By using this website, contacting us, or creating a Kiwi account, you agree to these Terms. If you're acting on behalf of a team or brokerage, you confirm you have authority to bind that team.
2. The Service
Kiwi is an AI operations agent that helps real-estate teams automate transaction work. It executes tasks at your direction (e.g., drafts offers, fills forms, pulls reports) and presents them for your review and approval before any client-facing action is taken.
3. Your responsibilities
- You are solely responsible for what you send to clients. Kiwi produces drafts; you approve and send.
- You must comply with all applicable real-estate laws, your brokerage's policies, and your local MLS rules.
- You must keep your credentials secure and notify us immediately of any unauthorized access.
4. Our responsibilities
We provide reasonable security, reasonable uptime, and reasonable accuracy. AI-generated drafts may contain errors; your review and approval is the final check before anything reaches a client.
5. Fees
Creating a workspace is free, and a workspace does no work until it is paid for. Using Kiwi requires an active subscription billed through Stripe at the price shown before checkout. A promotional rate you sign up on (such as the limited-time early sign-up price) stays with that subscription for as long as it stays active. You can cancel from the Billing page; access continues through the paid period. We'll give you notice before a renewal price changes.
6. Termination
You can cancel your subscription at any time from the Billing page. You may request an export or deletion of your team's data by emailing hello@kiwihomeagent.com.
7. Disclaimers
This website and the Service are provided "as is" without warranties. We are not a real-estate broker, attorney, or financial advisor. Drafts produced by Kiwi are not legal, tax, or financial advice.
8. Limitation of liability
To the maximum extent permitted by law, our total liability under these Terms is limited to the fees you paid us in the 12 months before the claim.
9. Governing law
These Terms are governed by the laws of California, USA. Disputes will be resolved in the state or federal courts of Santa Clara County, California.
